Please read these Terms of Use carefully. They govern your use of www.etechtools.co.uk (“our Site”), customer accounts, contact facilities and user-submitted content. They do not replace the separate contractual terms that apply when you buy a product.

By using our Site, you agree to comply with these Terms of Use. If you place an Order, our Terms of Sale and Returns & Refunds Policy also apply. Personal information is handled in accordance with our Privacy & Cookies Policy.

Nothing in these Terms of Use excludes or restricts any right or liability that cannot lawfully be excluded or restricted.

1. Definitions

  • Account means a customer account used to access account features on our Site.
  • Contact Tools means contact forms, live chat, messaging links or other facilities we make available to communicate with us.
  • Content means text, images, audio, video, software, code, databases and other material appearing on or forming part of our Site.
  • User Content means reviews, comments, questions, images or other content submitted by a user.
  • we, us, our means E-Tech Motors Limited trading as ETECH TOOLS.

3. Contacting us and standards of communication

You may contact us using our Contact Us page, by email at info@etechtools.com, by telephone on 020 8944 6994, or through a Contact Tool we provide.

When using our Contact Tools or communicating with our staff, you must not submit or communicate material that is unlawful, fraudulent, threatening, discriminatory, defamatory, sexually explicit, obscene, malicious, deliberately abusive, persistently harassing, privacy-infringing, impersonating, deceptive or intended to facilitate unlawful activity.

We do not require customers to be polite in order to exercise a legal right, but personal abuse, threats and harassment of staff are not acceptable. Where reasonably necessary, we may end a telephone, live-chat, WhatsApp or similar real-time conversation and require further communication to continue by email or post. Serious threats or suspected criminal conduct may be preserved and reported where lawful and appropriate. We will retain an accessible route for genuine complaints, statutory remedies and existing contractual matters.

We may retain and review communications for customer service, staff safety, quality control, dispute resolution, security, fraud prevention and legal claims as explained in our Privacy & Cookies Policy.

4. Access to our Site

Access to our Site is normally free of charge. You are responsible for the equipment, software, internet connection and other arrangements needed to access it.

Our Site is provided on an available basis. We may maintain, alter, suspend, restrict or discontinue all or part of the Site where reasonably necessary for security, maintenance, legal, technical or business reasons.

We do not guarantee that the Site will always be available or free from every error. This does not affect any contractual obligation relating to an accepted Order or any statutory right.

5. Changes to our Site and these Terms

We may update our Site and these Terms from time to time. The current version applies to use of the Site after it is published. A later change to these Terms of Use does not retrospectively reduce contractual rights relating to an Order already placed.

6. Accounts and account security

Certain Site features may require an Account. Account information must be accurate and kept reasonably up to date.

You are responsible for keeping your password and authentication details confidential and for taking reasonable steps to protect your Account. You must not knowingly permit unauthorised use or use another person's Account without permission.

If you suspect unauthorised access, change your password and contact us promptly.

We may temporarily lock, restrict or disable an Account where reasonably necessary to address a genuine security, fraud, abuse or Terms-of-Use concern. We may require reasonable identity or security verification before restoring access.

Closing an Account does not require us to delete transaction, fraud-prevention, legal, tax, warranty, dispute or other records that we are lawfully required or entitled to retain. Retention and deletion are explained in our Privacy & Cookies Policy.

7. Acceptable use and prohibited conduct

You may use our Site only lawfully. You must not:

  • use the Site for fraud, deception, unauthorised access or any criminal purpose;
  • attempt to gain unauthorised access to our Site, server, database, Account or another user's information;
  • introduce malware, malicious code, denial-of-service traffic or other harmful technology;
  • circumvent security, access controls, rate limits or authentication systems;
  • scrape, crawl, harvest or extract Content or personal information by automated means in a way that breaches law, imposes an unreasonable load, circumvents controls or infringes our rights;
  • use bots or automated systems to place fraudulent Orders, test payment credentials, create false Accounts, manipulate reviews or interfere with the Site;
  • misrepresent your identity or authority in a way that is materially deceptive;
  • use our Site or support facilities to facilitate vehicle theft, unauthorised key creation, dishonest mileage alteration, unauthorised system access or other unlawful use of automotive equipment; or
  • infringe our intellectual property rights or those of another person.

We may take reasonable technical and legal steps to protect our Site, users, staff and business against prohibited conduct.

8. Orders and product information

Use of the Site is separate from the purchase Contract. Product descriptions, prices, delivery information, cancellation rights, compatibility information and other sales terms are governed by our Terms of Sale and the information presented as part of the ordering process.

No statement in these Terms of Use makes physical Goods “sold as seen” or “sold as is” to a Consumer or removes statutory rights relating to Goods, Digital Content or Services.

9. Intellectual property

Except for User Content and third-party material clearly identified as such, Content on our Site and the intellectual property rights in it belong to us or our licensors.

You may view the Site, use ordinary browser caching and print or save reasonable extracts for personal, lawful use. You must not reproduce, sell, republish, commercially exploit, modify or systematically extract our Content without permission except where the law permits.

Nothing in these Terms restricts acts that copyright or other applicable law expressly permits without our consent.

10. User Content, reviews and fake-review prevention

If our Site allows User Content, you are responsible for what you submit and must have the right to submit it.

User Content must not be fake, knowingly false or materially misleading. You must not:

  • submit or commission a fake consumer review;
  • pretend to have bought or used a product when you have not, where that representation is material;
  • submit a review on behalf of another person while falsely presenting it as your own independent experience;
  • conceal an incentive, payment, free product or other material relationship where disclosure is required; or
  • manipulate review scores or review information by coordinated, automated or deceptive means.

Genuine negative reviews are permitted. We will not remove or suppress a genuine review merely because it is critical of us. We may, however, moderate, investigate, label, reject or remove User Content where reasonably necessary to comply with law or these Terms, including material that is fake, misleading, abusive, unlawful, unrelated to the reviewed transaction, contains personal information improperly, or otherwise breaches these rules.

Where we publish consumer reviews or review information, we may take reasonable and proportionate steps to verify, prevent, detect and remove fake, concealed-incentivised, false or misleading review content. This may include checking whether a review is associated with a genuine transaction or requesting reasonable verification.

You retain ownership of your User Content. By submitting it for publication, you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, moderate, display and communicate that content for the purposes of operating, securing and promoting our Site and products, and to retain copies where reasonably necessary for backups, complaints, legal compliance or evidence. This licence does not transfer ownership to us.

We may disclose User Content or related account information where required or permitted by law, including in response to a valid court, regulatory or law-enforcement request, subject to our Privacy & Cookies Policy.

11. Links to and from our Site

You may link to our Site in a fair and lawful manner that does not falsely suggest association, approval or endorsement.

You must not frame or embed our Site, use our logos or trade marks, or imply a commercial relationship without permission where permission is legally required.

Third-party links may be provided for convenience. Unless expressly stated, we do not control third-party sites and are not responsible for their content, privacy practices or availability. This does not exclude liability that cannot lawfully be excluded.

12. General information and reliance

General articles, FAQs, compatibility guidance and technical information on our Site are provided to assist users and are not a substitute for professional vehicle diagnosis, legal advice, safety advice or manufacturer procedures.

We take reasonable care with Site Content, but technical specifications and third-party coverage information can change. Product information forming part of a Contract is subject to the Terms of Sale and applicable consumer law.

13. Diagnostic, coding and programming information

Diagnostic, coding, programming, key, immobiliser, ECU, calibration and related operations can carry technical and safety risks. Information on our Site does not transfer control of a vehicle or programming operation to us.

Users are responsible for lawful authorisation, correct procedures, stable power, suitable backups and compliance with manufacturer instructions. Detailed allocation of contractual risk for purchased products is set out in our Terms of Sale.

14. Liability for use of the Site

This Part concerns use of the Site itself and not liability arising from the sale of Goods, Digital Content or Services, which is governed by our Terms of Sale.

Nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or restricted.

If you are a Consumer and digital content supplied by us through the Site damages your device or other digital content because we failed to use reasonable care and skill, any mandatory statutory remedy remains available.

For Business users, and subject to applicable law and reasonableness requirements, we are not liable for loss of profit, revenue, business, opportunity, goodwill, anticipated savings, business interruption or indirect or consequential loss arising solely from use or unavailability of the Site or reliance on general Site Content.

15. Security incidents, fraud and enforcement

If we reasonably believe that an Account, Site feature, payment attempt, review system or Contact Tool is being used for fraud, cyber abuse or other unlawful conduct, we may preserve relevant evidence, restrict the relevant facility, reject future automated requests, and make lawful disclosures to service providers, fraud-prevention or payment-security networks, regulators or law-enforcement authorities where necessary and proportionate.

Where prohibited conduct causes us loss, we reserve the right to seek recovery through lawful means. Any legal costs or expenses will be sought only to the extent legally recoverable.

16. Personal information and storage/access technologies

We use personal information and cookies or similar storage/access technologies as described in our Privacy & Cookies Policy.

17. Communications from us

We may send service communications concerning an Account, Order, return, security issue, legal notice or policy change where appropriate.

Direct marketing will be sent only where permitted by applicable privacy and electronic communications law. Marketing preferences and opt-outs are explained in our Privacy & Cookies Policy.

18. General terms

If any provision is found unlawful or unenforceable, the remaining provisions will continue in effect.

A delay in enforcing a right does not waive that right.

We may transfer these Terms of Use in connection with a transfer of our business or Site, provided this does not reduce any mandatory right.

19. Governing law and jurisdiction

These Terms of Use are governed by English law, subject to any mandatory law that applies to a Consumer and cannot be excluded.

A UK Consumer may bring proceedings in the courts available to them under applicable law. Business disputes relating solely to these Terms of Use are subject to the exclusive jurisdiction of the courts of England and Wales unless we agree otherwise.
